First off, I don't know what handicapme and certain others were expecting me to do about this.
It's not like I've been deleting this thread or censoring anything about Yebsite. The only thing I removed was a picture of Yebsite's baby momma, for obvious reasons.
This site's mission is to be a place where you can call out scammers and frauds in poker, without fear of censorship while doing so. On twoplustwo, threads like this one often get deleted, even when they have merit.
So this thread was created, and now we're discussing it. What more am I supposed to do?
I have never stated that this site's mission is for me to personally identify and chase down every scammer in poker, and bring them to justice. If that were the site's mission, I would be working 24/7 at it, and still not end up accomplishing it.
While I knew about Yebsite and the Anthony Scocozzo situation, I did not know all of the details until the Reddit post. I knew what every other longtime member of this community did:
1) Yebsite registered twoplustwo.me and posted links to copyrighted Two Plus Two material
2) Yebsite registered it in the name of some "weird kid" he knew from Scranton
3) Mason Malmuth tried to sue Yebsite, but ended up suing the kid instead, and won a default judgment
As has already been pointed out, this story goes back to 2011. What exactly was I supposed to do about this? Ban Yebsite from PFA when he signed up? If so, I'd have to ban anyone with past moral failings.
Here's what I didn't know prior to this thread:
1) The "weird kid" actually had Aspergers, and claims to have it badly enough to where he is disabed.
2) Yebsite's real name
3) Other stories about Yebsite's history that have come to light
I agree that this was a really shitty thing for Yebsite to have done.
Anyway, regarding this case:
It was tried in federal court because Anthony is in Pennsylvania and Mason is in Nevada. It is very difficult, and sometimes impossible, to sue people across state lines. Federal court made this jurisdictional issue go away, and I guess it was a legally valid thing to do since it involved something over the internet which was considered crossing state lines.
Anyway, this was a default judgment. You can get this default judgment reversed WITHOUT tens of thousands in lawyers fees, but through a fairly simple process:
The process is called "setting aside" the judgment.
You can set aside a federal judgment for one of three reasons:
1) The defendant was not served correctly. I doubt this applies here because Greenberg Traurig is a big firm and wouldn't make such a novice mistake.
2) The plaintiff requested a default judgment that isn't really valid (such as the defendant replied in time but the plaintiff claimed a default judgment anyway). This does not apply here.
3) There is a "good reason" why the judgment should be set aside. This involves the defendant providing a reasonable defense to the claim against him, as well as giving a reasonable explanation as to why he was not able to make the court case. This is the reason Anthony would use.
Now, the one problem with Anthony's story is the fact that he DID get served in 2010 and realized what was going on, but is only now attempting to tackle the situation in 2013 -- 15 months after the judgment was entered. He can claim he is "disabled" but was obviously competent enough to write that detailed Reddit post, meaning that he can't claim extreme mental deficiency or anything like that.
Anthony's best shot would be to hire a cheap lawyer for a few hundred dollars in Scranton, who can file the paperwork basically claiming that he was sued for something he never did, was a victim of identity theft, and that the counsel of the plaintiff wrongfully advised him to just let it go to default judgment because he is disabled and it 'wouldn't affect' him.
If Mason's lawyer admitted to this conversation (he probably won't), it would get vacated for sure.
If not, then there's some chance the judge would have sympathy (especially if Nick then took credit for what he did) and vacate it, telling them to sue Nick instead.
Legally, it's an interesting case, actually. Since I'm not a lawyer, I can't tell you what the precedent on this one is. Basicaly, if an identity thief commits fraud in your name, you get sued, and then you show apathy in defending the lawsuit and allow a default judgment to be served, can you later vacate it if you can prove you were a victim of identity theft? Or is it tough luck on you because you didn't defend yourself in time? That's an answer I don't have.

Yes I fuck them up occasionally like most people do. Checking my grammar on a message board is not the same as checking my grammar when writing an important email to a manager. I did plan to out him on poker websites because I do truely feel sorry for this anthony person, however I DID not make that post. I would not drag the poor handicap person into it. I think that person has been fucked with enough, and putting his name out there even more is just wrong. I do credit whoever made that. Nick Albino deserves all of this, and more. He truely is scum.
