One thing I'm surprised no one has mentioned is that he was charged with what is considered a "CLASS B" felony.
What is a Class B felony USUALLY?:

To be included in a class that includes stipulations for manslaughter, possessing child porn and aggravated sexual assault...well, I'm just not sure this should be. Perhaps this is a "trump up, then get what sticks" charge from an AG who is trying to make a name for himself (I wouldn't be surprised if Sheldon had a bit of influence here either).
BTW, based on what I've read, it seems that if convicted, the subject has to do *some* jail time with any Class B felony...no pleading out of that.
